Clinton fired the entire cabinet of US Attorneys because they disagreed with him politically. Yet, Gonzales was thrown under the bus for firing 6. Definite double standard here. It happens on both sides. Both had an absolute right to fire anyone they wished. Universities have bans on convservatives from speaking.Last edited by ajmccarrell; 09-12-2008 at 03:58 PM.. |

Please read MARBURY v. MADISON, 5 U.S. 137 (1803)
http://caselaw.lp.findlaw.com/script...ol=5&invol=137 Here is a good insight into it: http://en.wikipedia.org/wiki/Marbury_v._Madison Please note the Federalist regime's manipulation of the law in this case ![]() In the end and since 1803, the Court has had the ability to pronounce things Unconstitutional. Other than Roe, which you do not agree with, the system has worked fairly well; many have benefited from it. Moreover, without the review created in Marbury, supra, the 64 Civil Rights Act (the very one you think or at least (hopefully) thought the R's were responsible for ) -- would never have come about. So, while I readily agree that Justice Blackmun went bouncing thorough the Constituion with poms poms cheering P R I V A C Y -- how is the created right (which clearly is implied) such a bad thing What harm has it caused? True, many fetus' have been destroyed under it which many consider a bad act against an innocent - but holding that aside (after all I consider that a call between the mother and her maker) - what truly awful things have happened since the creation of the right to privacy? I suggest it has been overwhelmingly good in its application. Same with the Equal Protection and Due Process clauses. Again, some abuse has taken place and that is bad, but the end result generally is that we are a freer society with less govt. interference. So, I am willing to take the hit on the academic Federalist argument. How about you? In other words, other than that academic argument and some abuse of the system, hasn't Marbury been mostly stellar in its applications? |

The central philosophy may be the same of States Rights, but the Federalist Society certainly has evolved since 1803. Try going to a meeting. You might be enlightened. Why don't you go to their website for their statement of positions instead of a case from 1803 that has very little to do with the current party.
I mean, the democratic party today is VERY different from the democratic party 100 years ago, so why would the federalist party be the same as it was 200 years ago? What you essentially saying in the rest of your statement is, "ignore all the wrecks this car has been involved in and the fact that it is missing an engine, it's still a Porsche". |

![]() But, in http://www.academia.org/campus_repor...ry_2003_7.html The stated reasons for banning the student newspaper included the publication's policy of accepting off-campus donations and its establishment of a non-profit entity. The university also claimed the publication lacked a faculty advisor, which the paper's editors dispute. - - the Justice appeared to be unwilling to comply with the rules for being on campus. Thus, it is their own fault and not some banning of the content. By your own argument earlier regarding Roe, the Justice should have lobbied to change the University's rules. The "court" in this case applied the rule as written, which you should be proud of ![]() In the other one, there is not enough info. in the article and I haven't the time to google it. Wasn't calling you a Nazi ...I was making an analogy between a Jewish person voting for Hitler and a happily out gay person voting for a religiously preoccupied harpy that was going to fire a librarian for not taking a positive gay themed book off the shelves ..you figure it out from there.
