I don't think it's fair for anyone to be punished more harshly than another for committing the same crime. So yeah, I'd say this is a victory in that aspect.
On the other hand, I don't know for certain the level of either partys disability so it's hard to say whether or not the younger boy was taken advantage of.
For instance, if any person of average mental capacity (male of female) took advantage of another person of below average mental capacity (male or female) I'd be inclined to think that the punishment should be a little more severe than had both parties been on the same level. If that makes any sense...?
