"Crying in the Night" by Firefall

Here is a treat for you!

http://s48.yousendit.com/d.aspx?id=0...H28GVEST51PUBY

It is a cover of "Crying in the Night" by the band Firefall. It was made available as a bonus track on the 1995 re-release of their 1980 album Undertow. As far as I can tell, it is out of print now, so I believe I can share this with you.

Very, very cool. Thank you. It's pretty close, too. I really like it. I've never heard of that band, but I like the way they sound. Is this somewhat typical of their other work?
What are the rules for people covering BN songs, does anyone know? Since Stevie and Linds own it.
God, I have to listen to BN again. It's so lovely.

thanks for this. I really like it. It's nice to hear a man's vocal on this song. I wish there was a little more harmony.

Wow ~ I love firefall ~ thanks for posting.

You bet..."Crying In The Night" is a perfect cover for them...sounds incredibly similar to their own work.

Their hits:

Strange Way
Livin' Ain't Livin'
It Doesn't Matter (a cover of a Stephen Stills tune)
Cinderella
Just Remember I Love You
You Are The Woman
Goodbye, I Love You

They were actually a sort of country/rock supergroup.
Their original lineup:
Rick Roberts: guitar, lead vocals (ex-Flying Burrito Bros)
Michael Clarke: drums (ex-Byrds, ex-Flying Burrito Bros)
Mark Andes: bass (ex-Spirit, ex-JoJo Gunne, pre-Heart)
Jock Bartley: lead guitar (ex-Zephyr...he replaced the late Tommy Bolin)
Larry Burnett: guitar (cab driver in Washington DC)

When Andes left to join Heart and simultaneously Michael Clarke left, the new rhythm section was George Hawkins (we know him, right?) on bass & Tris Imboden (who was between stints as Kenny Loggins' drummer)

Are you really suprised that I didn't know them? Really? I didn't even know that FM did FM's songs until I was 20. I'm the anti-muso.
I can't remember hearing any of those songs. That's odd.

Thanks for the info. Guess I'll have to check em out. :)

Anyone can cover any songs they want. One doesn't need L&S permission to record their material- you just gotta pay them their royalties. ASCAP & BMI make sure that artists get their royalties paid properly.

I could have covered "Races Are Run" on my last album and I probably would have owed Stevie about $0.45 in total....

That's not quite what I thought I learned in my intellectual property class.
I'm not doubting you, that just seems strange.
and I think you should cover Frozen Love. :D Races are Run isn't my fave BN song. Yes, I know you were just saying that to illustrate a point. Nevertheless....

What?! Oh, of course, why would we like the same song? S'okay, dog, you couldn't handle the FL vocal anyway.

I'll have to review my IP stuff. Because during it I was pretty much thinking of how what I was learning relates to the mac, anyway. If you've set up and run things and released albums, it seems like you would know.

I didn't really express myself well and deleted my post and of course, you quoted it.   No biggie.

The bottom line is that, yes, if you, Amber, wanted to record and release a CD with one of Stevie's songs on it, you would have to get the licensing to do so. However, I doubt that a refusal of licensing on that level ever happens because it's just adding more cash to the pile.

Where it comes up more often is where an entity wants to use an actual recording to push their product. The legal mechanics are the same (both this example and the one I listed before would have to get licensing to use the song), however, the intent is different.

I can't recall ever hearing of an incident where a songwriter refused a reproduction right license to someone who wanted to cover their work- if one wants to be a professional songwriter they want anyone and everyone to record/play their stuff. Any music biz people (John Run ???? Hayley ????) who have examples, post 'em.

I'm not sure why the whole "Mick wouldn't let me use 'Silver Springs' on Timespace caused me to leave Fleetwood Mac" thing happened with Stevie. I can't imagine that she would have to get any kind of a license from him to release her own work. I would imagine that Warner Bros owns the masters to the Rumours sessions and they would be the one to issue the license to include it on Timespace.

All this legal crap is NOT my cup-o-tea.....

Any by the way- I have no problems whatsoever pulling off the vocal on "Frozen Love" beyotch. :p

amber 02-22-2006 06:50 PM

 I know, I know. As I struggle to get the harmony. I mean, I can sing it, I just can't always find it.

Okay, what you said makes sense.
There obviously was some big problem with Stevie using Silver Springs though, or you can bet it'd be on there. I think I'll check it out. :)

Interesting about Mark Andes, who toured with Stevie during TimeSpace. Maybe he's the one who "found" this song to re-record?

Sorry to give this a bump but does anyone have a running time for this Firefall version? Can't seem to find a running time for it anywhere and I need it for the discog. Thanks in advance for the replies. :)

John

Firefall opened for Fleetwood Mac on the Rumours Tour. Mick Fleetwood was involved with Firefall's band management in 1978. The album Undertow with Crying in the Night was originally released in 1980. George Hawkins from Firefall went on to play with Mick Fleetwood's Zoo.
