Don Henley sues Senate candidate over song use

(CNN) -- Don Henley, a founding member of "The Eagles," is suing a Republican candidate for the U.S. Senate, claiming the candidate is misusing two of his popular songs.

The suit filed Friday in federal court in California claims Charles DeVore is using Henley's hit songs "The Boys of Summer" and "All She Wants to Do Is Dance" without authorization.

The suit comes from two campaign videos that DeVore posted on YouTube that used Henley's music, according to the lawsuit.

In one of the videos, DeVore's campaign changed the words of "All She Wants to Do Is Dance" to lyrics that attacked Sen. Barbara Boxer, the lawsuit alleges.

Mike Campbell, Henley's producer, is also named as a plaintiff in the lawsuit.

"Don Henley and Mike Campbell brought this action to protect their song, 'The Boys of Summer,' which was taken and used without their permission," Henley's spokesman said. "The infringers have vowed to continue exploiting this and other copyrighted works, as it suits them, to further their own ambitions and agenda. It was necessary to file a lawsuit to stop them."

DeVore, a member of the California State Assembly, is running against Boxer, a Democrat, in the 2010 election, according to his Web site.

DeVore mentions Henley's legal actions on the Web site.

"We're responding with a counter-claim, asserting our First Amendment right to political free speech," the site said. "While the legal issues play out, it's time to up the ante on Mr. Henley's liberal goon tactics. By popular request, I have penned the words to our new parody song."

DeVore then posted the lyrics of a song he called "All She Wants to Do Is Tax."

For whatever reason, I never realized that Mike Campbell produced these songs.
And yeah, the song parody sucks. I would be pissed if they butchered my song that way. It doesn't help that this candidate is going after one of the most beloved lefty senators either.

I guess it's ok to write political songs just as long as the other side doesn't use them. All is fair in love and politics. Maybe he needs to put a disclaimer like "for Democratic Party Use Only" on all his material. It's time we stop being party hacks and start being Americans again! -eh Don?

I expect responses like this from people who are close minded. If the guy has violated the law then he should be punished otherwise Don Henley is the idiot. End of story.

I'm extremely open-minded. How would you feel if you were in Don Henley's place, gman?

Once you start writing political songs, Carrie, you give up the right to control who uses your songs, didn't you know that?

I thought it was a song about being an ageing hippie but I could be wrong
I did hear that Witchy Woman is deeply political commentary on the Nixon administration though

The closest thing to political I can think of is Little Tin God and If Dirt Were Dollars. They're not so much political to me as they are a statement about society as a whole.

I think "Long Road Out of Eden" is about involvement in the Middle East, but I could be wrong. Other than that I can't think of any.

People parody songs all the time for commercials. People use songs in commercials all the time. I just think that he should remember that his audience is made up of people from all parts of the political spectrum. Also I said if this guy has violated copyright law then Don is well within his rights to go after him. I would love nothing more than to see artists work not degraded for any commercial. However in the real world that is just not the case. I just didn't expect this kind of action from someone who wrote Dirty Laundry. So I will say my sincerest apologies to any and all who were offended by my comments. Of course Don has not written political material. Love and Peace to all. Yeah I'm an old hippie and yes the drugs were that good and no I'm not still doing them although you would have a good case to argue that I haven't come down yet.
