Sony/ATV which Michael Jackson owns 50% of and the other 50% being owned by Sony have these Stevie songs listed in their catelogue. And although Sony/ATV owns the publishing rights, they still have to pay the artist (Stevie) royalties based on everything from other people recording the songs to radio play, tv use.. everything. The publishing company collects the funds for the use of the music, takes their cut and the artist is then paid royalties either yearly, quarterly or something like that. Its all in percentages.

Someone has to monitor and collect based on the use and play of the music, Stevie can't very well do it on her own... that's what companies like Sony/ATV are in place for.

Well, not really.

There are all kinds of royalties. Sony/ATV is a publishing company which administers the rights for Welsh Witch Music, which is Stevie's publishing company. BMI and ASCAP are the associations which monitor the publishing and airplay royalties and distribute the cashola. They make sure the artists get their fair share of the publishing royalties as set out in the recording contract. The Sony/ATV is an arm of the record company that siphons off a certain amount of money depending on what is negotiated in the record contract. Some artists own their publishing, however, most have a percentage of their publishing rights owned by the record companies.

Anyone can have a publishing company. All you have to do is fill out the forms, pay the fee and register with ASCAP or BMI. However, if you sign a record contract with a major/minor label they are going to demand a significant portion of your publishing rights (as well as ownership of your masters and a whole slew of other crap).
