PIERRE, S.D. - Abortion should be a crime in South Dakota if states are given the right to outlaw the medical procedure, a House panel recommended Friday.

The State Affairs Committee unanimously approved HB1249, which would make it a felony to do abortions if Roe v. Wade, the 1973 U.S. Supreme Court decision legalizing abortion, is overturned. The bill would allow exceptions in cases where a pregnant woman's life is at risk.

Those who do abortions could face up to two years in prison and a $2,000 fine.

The committee changed the bill to remove a provision that would have made it a crime to advise women to seek abortions.

Rep. Joel Dykstra, R-Canton, the bill's prime sponsor, said it is designed to protect the rights of fetuses in case states are given the right to regulate abortion.

Rachel Hansen of the South Dakota Right to Life Committee, which helped draft the bill, said abortion rights supporters are gearing up for a fight in case the Supreme Court overturns Roe v. Wade.

"In South Dakota, House Bill 1249 would throw a monkey wrench right in the middle of that strategy," Hansen said.

Rob Regier of the South Dakota Family Policy Council urged the committee to pass the bill.

"Send a message that South Dakota is more than just prepared to protect the unborn, but eager to," Regier said.

Kate Looby of Planned Parenthood said the bill is one of the most extreme measures she has seen. The measure would tie physicians' hands and ignore women's ability to make decisions for themselves, she said.

"Making abortion illegal never has and never will stop women from having abortions," Looby said, urging the committee to reject the bill.

Jennifer Ring of the American Civil Liberties Union said the bill makes no provisions for abortions in cases where a woman's health is at risk or a fetus develops a potentially fatal condition. In such cases, women would be forced to allow the pregnancy to develop until it threatens their lives, Ring said.

HB1249 goes now to the House floor.

Is it predicted to pass?

I think we are going to see alot of this. It is all irrelevant if Roe holds. AND - interestingly, I am unsure of the ramifications of passing a law that is illegal? I think a Federal Court could enjoin that - but I do not really know.

Oh surely there's no problem with the state inviting itself into a woman's uterus? Perhaps they can enjoy a little tea party whilst they're in there.

this is all so frightening. i am literally sick to my stomach thinking that roe v. wade could possibly be overturned...

consider how much younger people are becoming sexually active than they were in 1974 (when abortion was legalized) ... if this happens we will have so so many children having children... and so so many women having unsafe, illegal abortions. people who are not ready or can't afford to have children will be living on welfare or not finishing school while they try to take care of an accidental child.

for those of you who are against abortion, fine, great, i respect your views and i will never make you have one. but don't you ever f*cking tell me that i can't choose to have one if i need to. to each his own. go to hell.

Imagine the financial consequences just in terms of lost work. All that unpaid time off work (some places pay, but not all). What if the woman's single and has no other means of support other than herself?

that is a very good point... and most women or teenagers who accidently get pregnant and are most in need of an abortion don't have those fabulous jobs that offer benefits and maternity leave. I used to work with a girl who was 27 at the time she accidently got pregnant, her boyfriend LEFT HER, and when she left to have her baby she didn't have any income as our job didn't offer maternity leave or any sort of pay... and merely considered her an ex- employee.

also... we are seeing more and more lately that many companies are changing their policies as to who is eligible for health benefits... "full time" status is changing as are the amount of hours worked to qualify for benefits... many companies will send employees home in the middle of a shift to prevent them from crossing over into the "eligible" territory. the last thing these poverty level women need is a child they can't support or take to a doctor... they can't even take care of the hospital bills when the child is born! and whose pockets will their welfare checks or food stamps come out of? yep... ours.

f*ck this.... let people have abortions... otherwise we'll have a lot more issues and costs to deal with. i shudder at the thought of a scared 15 yr old girl using the old wire hanger method.

This is when I tend to get far more liberal in my views. I don't believe government has the right to invade my life or anyone elses by telling them what is wrong and what is right in regards to their uterus (or any private issue for that matter).

I knew quite a number of people that used it as a form of birth control while we were in high school and while I think THAT is wrong and disgusting, to each his own. These were girls from wealthy families who didn't want to shatter daddy's image of the pure virginal girl they were supposed to be. Whatever to that. I'm not the one who has to live with the fact that I couldn't keep my panties on, take a pill or tell my skeezy partner to wrap it up.

Everyone is entitled to their opinion on the subject matter and while I can't picture myself actually having one, there are times when it is necessary and if faced with a situation where one might be necessary, I would want the option. I don't like the idea of someone repeatedly using it but you can't tell one person they can have one and then another person, they can't...you can't draw a line or make case by case exceptions. However, doing away with it completely is only going to cause more problems.

There are a lot of Republican women in offices who are against making abortion a felony. I hope EVERYONE speaks up on this.

Not only that, but I would think that they would have to repeal that bit of welfare reform that says you don't get anymore aid if you have more children. In a pro-life society, how could they force these women to have children and not pay for them...

some of you know I work in social services and I know something about those rules...and I agree that a society that forbids birth control or abortion (not abortion AS birth control-please note) SHOULD have infrastructure in place to care for these THOUSANDS of extra babies. But, I fear, the sad reality is that the pro-lifers dont care (or maybe arent thinking?) about the quality of life for these kids once they are here. It wont matter that mostly the POOR are having more babies, and the standard of living for each succeeding child is progressively WORSE....or that our hospitals and nursing staff will be even MORE overloaded, and our cities even MORE crowded....There needs to be more foresight all around, because looking at only one aspect of an issue without considering the rest will bring the whole house of cards tumbling down.

Supposedly, there's always a chance that it can be a happy life. I suppose that chance is there, though it's a slim one. Those who believe it's murder are going to say that murder is never justified.

Of course some people will refuse to face up to the realities of what a pro-life society will actually mean. But if the rest of us keep bringing these things out into the open, perhaps those who hadn't considered these realities may start to do so.

"Pro-life" is not a moral position; it's a political one. People who would never even consider an abortion may choose to take a different stand politically when faced with some real ugly issues that would be the result of a pro-life society. Or at the very least, come to appreciate what those issues are, and perhaps address them.

I mean, hell, if conservatives want to promote this "culture of life", make it easy for women to get pregnant and have babies. Legislate paid pregnancy leave for women who are working when they get pregnant. Subsidize the crap out of child care...how about making it an extension of the public school system? And make the hiring qualifications on par.

I mean if every child deserves a chance, than we should pour all the resources we can into children, right?

Nope, you're not off--I did say those things. I like to think of myself as moderate but then again, I also like to think that most of the population of the US is moderate and gets stuck being pigeonholed into one category or another. My views on foreign affairs are generally conservative but when it comes to things like abortion and gay rights, i'm more liberal because I don't think government has the right to step into anyones life and tell people how they should be living. I don't side completely with either party because I don't feel 100% passionate about everything each stands for and will do for me.

I think you and I think along the same lines and that makes us truer to the definition of "conservative" than anyone I know about in national politics - they are all for using Jesus to control irrelevant aspects of peoples' private lives as a vehicle to keep them in power so they can use that power to make money. It truly is sickening.

That's exactly right. Yes, you and I are pretty much always on the same wavelength when it comes to politics. As far as I'm concerned, the right steared too far to the right and the left went too far left. That leaves us nowhere for advancement, IMO. In all good conscious, I can't call myself a conservative nor can I call myself a liberal. Funny thing you mentioning the use of Jesus...think back to times in history when God was used much for the same purposes. Those damn cycles...

Moderate needs to be the new conservative.

A, so, are you a classic "fiscal conservative" maybe? And the kind who thinks gov't should be "hands off" when it comes to business and social programs?

I mean if every child deserves a chance, than we should pour all the resources we can into children, right?Good points there. Great post. I shouldn't be so cynical and assume that no one will bother to look at the other side. There must always be someone who's willing to do that, if for no other reason than to be certain that he is secure in his own views about the subject and has all his bases covered. One can only hope that someone would be able to look at it objectively, and what you've presented there has to be considered, IMO.

I think Mary has some good points, but I imagine she can discuss those points until she's blue in the face and some pro-life people will continue to say that none of that matters because one should be given a chance at life, regardless of the quality of that life. Supposedly, there's always a chance that it can be a happy life. I suppose that chance is there, though it's a slim one. Those who believe it's murder are going to say that murder is never justified.

howzabout this: when a gal is going to an abortion clinic and the pro-life protesters are yelling at her about MURDER! then I think she should say to them: I will stop right now and not go in there if any one of you will sign a legal document offering to ADOPT my child once it its born. You must also pay for my medical expenses from now until the baby is born. It must be BINDING (God forbid a church goer break a LEGALLY BINDING CONTRACT!!)
I wonder just how many GOOD CHRISTIANS would step up for that kind of offer? And I think there should be some sort of HUGE financial penalty if the pro-lifer breaks the contract... HUGE!!

Dude, i'm not pregnant and i never have been, but i soooo want to make rounds of the abortion clinics nearby and tell the protesters i won't have the abortion if they sign a contract to pay every expense related to the baby... it would be priceless to see the looks on their faces!!

i was involved in a counter protest in high school... it was a catholic school and they rounded up good catholic kids to go down to the abortion clinic on saturday to protest... so three of my good friends, Fitz, Mark and Stephanie and I went down with our own signs... "against abortion? don't have one!" "my body my choice" you know, all those ones... needless to say we were not popular with campus ministry on monday morning.

But, of course. There was an article in Rolling Stone a month or so back about this one guy who goes around protesting abortion clinics in California, he's a real piece of work. Protests right in front of doctors' houses and everything. The article sticks out in my mind because I found it incredibly offensive and distasteful on the part of Rolling Stone because they showed one of his flyers with a picture of an actual aborted fetus. I couldn't believe it.

Back home the abortion protesters always had pictures of aborted fetuses on their signs and such...it was scary -there was a good mix of men and women though....

There were also a couple of hard-core nuns who'd wear sandwich signs and stuff one of them was arrested once for being involved in an abortion clinic bombing - way to be good Christians ladies...

Not that I have seen every flyer out there, but pretty much ALL of the ones I have seen (which is not that many) misrepresent a three month or less fetus - rather, they show a fetus at eight months. That says to me they are scared taht if they show what the fetus looks like during the frist trimester, people will look at them and say - this is not a child yet. COWARDS!

With all due respect, paying protestors is not necessarily limited to political party  AND - for many of these people, the R party is FAR too liberal for them. which in and of itself is terrifying

For the sake of Tower :wavey: I am not detracting from the sliminess of the R party, they seemingly are far worse in every aspect than the just sleazy D's.

Where should we start - perhaps the Clinton give me money and here is your pardon, Clinton's essential sale of the poor's benefits in the "Contract with America," the D's support in the budgets W has passed, and so on and so on. Plus, the D's over the years certainly have bought votes and planted hecklers  So, I say although I cannot stand the R moreso, I think the D party is the lesser of two evils.

the precise focus was REPUBLICANS paying pro-lifers to protest and YOU said the Dems did it too, which was off point(AND unnecessary!). Now, Im sure you have your reasons for your comments about the evil Dems, but wouldnt it make more sense to start a new thread with the PROOF? just a thot.

as for your second point: If the Dems DO abandon abortion rights, I will abandon THEM. They will NEVER regain their former glory if they cast off one by one the historical planks of their platform. Those very aspects of personal rights and concern for the marginalized members of society are what differentiated them from the Republican Juggernaut. The rabid Fundamentalists are ruining this country with their single minded quest to restrict EVERYONE but rich white males. (as it was in the beginning, it is now and ever shall be.........) what passes for religion nowadays makes me want to GAG. with a spoon.
