Losing by 335,000 in N.H., Nader Demands a Recount
By Jonathan Finer and Brian Faler
Wednesday, November 10, 2004; Page A07
Independent presidential candidate Ralph Nader, who lost by about 335,000 votes in New Hampshire, has asked the state for a recount.
No, the longtime consumer advocate is not hoping to change last week's outcome in the Granite State, where Democrat John F. Kerry was the winner. Rather, he said, he is concerned about the veracity of the results.
"We have received reports of irregularities in the vote reported on the AccuVote Diebold Machines in comparison to exit polls and trends in voting in New Hampshire," Nader wrote Secretary of State William M. Gardner. "These irregularities favor President George W. Bush by 5% to 15% over what was expected."
New Hampshire uses Diebold machines at 132 polling places. Gardner's office received Nader's fax at 4:59 p.m. Friday, one minute before the deadline. Under state law, if a candidate requesting a recount finished more than three percentage points behind, he must pay for the process. Gardner said that if the Nader campaign sends a check for $2,000 and promises to pay any additional charges, he will round up the ballots and initiate a hand count.
Spokesman Kevin Zeese said Nader was planning to send the check yesterday. "Either it will allay people's fears about the results, or it will open the door to looking at other states," Zeese said.

Ralph Nader will hold a press conference today at 1:00 pm to announce his New Hampshire recount.
I am hearing from reliable sources that citizens in Ohio will be requesting recounts there.
I am also hearing that Florida is going to be recounted and that some kind citizen is going to pay for it.
A private citizen has already requested a recount in Nevada.
A 527 has been created to accept donations for recounts in New Hampshire, Ohio and possibly Colorado and New Mexico. Those interested in donating can do so at www.helpamericarecount.org

Soros has chosen acceptance, it seems :(. "Post-election comment" from his website:
Obviously, I am distressed at the outcome of the election. I hope, but don't trust, that the second Bush administration will have learned something from the mistakes of the first. What is at stake is our ability to recognize our own fallibility.
I established GeorgeSoros.com in order to engage in a critical discussion with readers about President Bush's policies, particularly in Iraq. To all those who sent in messages, thank you. I found the dialogue to be thought provoking, and I hope visitors to the site did as well. Georgesoros.com proved more popular than I initially imagined. There have been more than a million and a half visitors to the site and more than 30,000 people sent in messages.
Having established the site in the run up to the election, I frankly did not pause to consider what to do with it afterwards. Given the outcome, I now feel strongly that it should continue. Exactly what shape the future content will take, and how actively I will pursue the weblog, will take some time to figure out. In the meantime, I am traveling to Europe to attend to the business of my foundation - but I'll be back.
Please check back in a few weeks for updates. Thank you.

I think they are resigned to there are not enough votes being talked about here to make a difference. I am not saying that is the case though - but Kerry was armed with a flotilla of lawyers and some of the best statisticians and political minds - they all concluded drop it - that must count for something. I also think they may think for some reason it is political suicide to go down this road. AND - who knows the D's may not want to examine it too closely for fear of D culpability on the local level - I mean it probably exists on both sides
Finally, maybe Kerry, being the true elder statesman that he is realizes another 2000 Florida would not be good for the nation and instead dropped it and left it to the Congress.
Who knows in the end. But, I do think if they can prove fraud they need to - and that is not matter who committed it. Moreover, if it is not fraud but just a mistake - that needs to be known as well so it does not happen again.
We shall see how this plays out.

I know. I can't believe they are seemingly dismissing all of this. I didn't begrudge him for conceding, one week ago. Now there's enough evidence to, at very least, warrant investigation (if not construct a case). There are Ph.D. statisticians, computer programmers, and political analysts all saying something is very wrong here. It's not just an internet(s) rumor, regardless of what Peter Jennings and the lapdog hacks at CNN would have you believe. I'm giving Kerry & his camp the benefit of the doubt, but only for so long. Where's the GELAC fund? The 17,000 lawyers? The "change strategy as information comes in" approach and the "every vote will count and be counted" attitude? Continue to do nothing, and don't count on my support in 2008.

They concluded to drop it before half the evidence even came in. If you take the composite of ALL the evidence for fraud, errors, glitches, negligence, manipulation... however the hell you want to label it, there's enough to argue that the outcome of the election could very well have been different. 92,000 more votes than registered voters in a single county in OH? 4,000 more votes (for Bush) than registered voters in another county? The 136,000 vote margin by which he lost the state (not including provisionals, which are likely to break for Kerry) suddenly looks a lot smaller.
Besides, this needs to be looked into by someone whether it was enough to flip the election or not. "Sorry, it looks like fraud occured but not enough for us to win, so who cares!" ? Um, no.

"Serious problems surfaced in this election that must be addressed at the state and national level. Some were inefficiencies in handling the massive turn out. No citizen should have to wait for hours to vote, or worry whether their vote was actually counted.
Glitches in electronic voting in the Columbus area should move all legislatures to demand paper receipts for voting machines. Without such a paper trail, no true recount can ever be done."
"I believe we must pursue every lead which raises questions about the integrity of the electoral process. Our work may not change the outcome, but it will demonstrate that beyond our commitment to our candidates, we have a higher commitment to our democracy."

FBI denies warning officials of any special threat
LEBANON - Warren County officials, facing scrutiny of their decision to lock down the administration building on election night, say they were responding to a terrorist threat that ranked a "10" on a scale of 1 to 10.
The information, which Commissioner Pat South said was previously deemed confidential, is coming out a week after the public was barred from viewing the Warren County vote count. The Ohio Secretary of State's office doesn't know of any other county in the state to impose such a restriction.
County officials initially said they feared that having reporters and photographers present could interfere with the ballot counting. They subsequently cited homeland security concerns.
Now, they say an FBI agent told them that Warren County ranked a "10" on a terrorism scale. However, state and federal homeland security officials said Tuesday they were unaware of any specific threat against the county.

Nader has till Friday to pay $2,000 filing fee to launch N.H. recount:
Independent Presidential candidate Ralph Nader has until Friday to pay a $2,000 filing fee to request a recount of New Hampshire votes and to pledge to cover the costs of the count.
Kevin Zeese, a spokesman for Nader's campaign, said that N.H. Secretary of State Phil Gardner, a Democrat, has agreed to the new deadline.
Nader held a press conference in Washington, D.C. this afternoon to confirm his faxed request for a recount, filed one minute before Friday's 5 p.m. deadline.
Zeese said Nader will ask that votes be recounted in particular wards -- urban areas where 78 percent of the votes were cast using the Diebold AccuVote system.
Zeesem reached by telephone this afternoon, said the recount would begin as soon as possible after these conditions were met on Friday.

Calif. settles electronic voting suit against Diebold for $2.6M
Wednesday November 10, 2004
By RACHEL KONRAD
AP Technology Writer
SAN FRANCISCO (AP) California Attorney General Bill Lockyer announced Wednesday a $2.6 million settlement with Diebold Inc., resolving a lawsuit alleging that the company sold the state and several counties shoddy voting equipment.
Although critics characterized the settlement as a slap on the wrist, Diebold also agreed to pay an undisclosed sum to partially reimburse Alameda, San Diego and other counties for the cost of paper backup ballots, ink and other supplies in last week's election. California's secretary of state banned the use of one type of Diebold machine in May, after problems with the machines disenfranchised an unknown number of voters in the March primary.
Faulty equipment forced at least 6,000 of 316,000 voters in Alameda County, just east of San Francisco, to use backup paper ballots instead of the paperless voting terminals. In San Diego County, a power surge resulted in hundreds of touch-screens that wouldn't start when the polls opened, forcing election officials to turn voters away from the polls.
According to the settlement, the North Canton, Ohio-based company must also upgrade ballot tabulation software that Los Angeles County and others used Nov. 2. Diebold must also strengthen the security of its paperless voting machines and computer servers and promise never to connect voting systems to outside networks.
``There is no more fundamental right in our democracy than the right to vote and have your vote counted,'' Lockyer said in a statement. ``In making false claims about its equipment, Diebold treated that right, and the taxpayers who bought its machines, cavalierly. This settlement holds Diebold accountable and helps ensure the future quality and security of its voting systems.''
The tentative settlement could be approved as soon as Dec. 10.
The original lawsuit was filed a year ago by Seattle-based electronic voting critic Bev Harris and Sacramento-based activist Jim March, who characterized the $2.6 million settlement as ``peanuts.''
March, a whistle blower who filed suit on behalf of California taxpayers, could receive as much as $75,000 because of the settlement. But he said the terms don't require Diebold to overhaul its election servers which have had problems in Washington's King County and elsewhere to guard them from hackers, software bugs or other failures.
The former computer system administrator was also upset that the state announced the deal so quickly. Several activist groups, computer scientists and federal researchers are analyzing Nov. 2 election data, looking for evidence of vote rigging or unintentional miscounts in hundreds of counties nationwide that used touch-screen terminals. Results are expected by early December.
``This settlement will shut down a major avenue of investigation before evidence starts trickling in,'' March said. ``It's very premature.''
A Diebold executive said the settlement would allow the company to spend more money on improving software and avoid ``the distraction and cost of prolonged litigation.'' Diebold earnings plunged 5 cents per share in the third quarter because of the California litigation, which could cost an additional 1 cent per share in the current quarter.
Diebold shares closed Wednesday at $53.20, up 1.22 percent from Tuesday in trading on the New York Stock Exchange.
``We've worked closely with California officials to come to an agreement that allows us to continue to move forward,'' Diebold senior vice president Thomas W. Swidarski said in a statement. ``While we believe Diebold has strong responses to the claims raised in the suit, we are primarily interested in building an effective and trusting relationship with California election officials.''

Presidential Candidates To Demand Ohio Recount
Press Release
David Cobb and Michael Badnarik, the 2004 Green and Libertarian presidential candidates, today announced their joint intent to secure a recount of presidential ballots cast in Ohio.
"Due to widespread reports of irregularities in Ohio's voting process, we are compelled to demand a recount of the Ohio presidential vote," the two candidates said in a joint statement. "Voting is at the heart of the American political process and its integrity must be preserved. When Americans stand in line for hours to exercise their right to vote, they need to know that their votes will be counted fairly and accurately. We are acting to protect the rights of the people of Ohio, and the rights of all Americans. Public trust in the democratic process is at stake."
The candidates also demanded that Ohio Secretary of State Kenneth Blackwell, a Republican who chaired the Ohio Bush campaign, recuse himself from the recount process.
Ohio's election proceedings were marred by numerous press and independent reports of voter intimidation, mis-marked and discarded ballots, problems with electronic voting machines and disenfranchisement -- apparently by design -- of African-American voters. A number of citizen and voting rights organizations will hold hearings this Saturday in Columbus, Ohio to give an airing to, and investigate, these claims. The hearings will be held from 1-4 p.m. at the New Faith Baptist Church, 955 Oak Street. Voters, poll workers, journalists and voting experts are invited to testify. A second hearing will be held on Monday at a location to be announced, from 6-9 p.m.
The Badnarik and Cobb campaigns are in the process of raising the required fee, estimated at $110,000, for securing a complete recount. The campaigns are accepting contributions through their web sites. The Badnarik-Campagna website is http://www.badnarik.org. The Cobb-LaMarche website is http://www.votecobb.org.
Throughout this election cycle, the Cobb and Badnarik campaigns have worked together in a spirit of cooperation and civility rarely found in electoral politics. The campaigns jointly participated in and/or sponsored a series of independent debates, and the two candidates were arrested together in St. Louis protesting their exclusion from the restricted, two-party corporate-sponsored "debates." Now, as the election results remain in question, Michael Badnarik and David Cobb are proud to once again act together on behalf of the rights and interests of the American people in reaching the truth.

Nader calls for US election recounts
Thu Nov 11,10:31 AM ET U.S. National - AFP
WASHINGTON (AFP) - Ralph Nader, an independent presidential candidate this year, has called for recounts of November 2 voting results saying that amid allegations of irregularities, he wanted to ensure that every ballot was counted.
Nader, who this year drew about one percent of the vote nationally, told a press conference Wednesday he was speaking out for the "thousands" of US voters asking for recounts and not on his own behalf.
"Over 2,000 citizens including voting rights advocates are urging in writing the Nader Camejo campaign to help make sure every vote is counted and counted accurately. The Nader Camejo campaign does not view the election to be over merely because concession speeches, which have no legal effect, have been given. Rather they are over when every vote is counted and legally certified," Nader said.
He urged recounts particularly in the hotly disputed states of Ohio and Florida, which went to Bush, New Hampshire which went to Kerry, and North Carolina, which went to Bush.
Nader highlighted irregularities including one reported earlier in an Ohio polling station where 638 voters cast ballots but results showed 4,258 voted for Bush, and 260 for Kerry.
"Striking inconsistencies exist between the vote as reported on the AccuVote Diebold Machines and exit polls and voting trends in New Hampshire. These irregularities in the reported vote count favor president George W. Bush by five to 15 percent over what was expected.
"Problems in these electronic voting machines and optical scanners are being reported in machines in a variety of states," Nader added.

NBC reported about an hour ago that they have been overwhelmed with positive responses about Olbermann and his coverage of the election fraud and that because of this, Olbermann will report much more of it and the other networks look like they will be following suit.
Keep emailing Olbermann to tell him what a marvelous job he's doing!
